Thanks Weblord, I looked up 'rolexes' for a TM under the Madrid system on the WIPO site but nothing there. Also, the term 'rolexes' is used on other sites....bit confusing...
I've heard people refer to multiple Rolex watches as "Rolexes". I would think it'd be considered confusingly similar and being used in bad faith if you put anything about watches on the domain, but I'm not a lawyer and that's just my personal opinion..
That said, http://www.rolexes.net/ is owned and being used by a large jeweller (who also sells pre-owned Rolex watches among other things).
Are you certain the C&D is legit there have been a few people sending fake ones lately (eg. a fake law firm pretending to be representing Rolex)...
Reece, it is I am sure Rolex is aware of this. It is possible they allow it because they company is a licensed seller of Rolex. Many companies will allow you to use a TM when you have a partnership.
Then again, they have this disclaimer at the bottom "B. Gray Jewelers, Inc. is not an authorized dealer of any watch printed or seen here."..

I would look into who sent that letter and maybe even discuss with rolex if you are seriously considering handing it over do it direct with them.
I know of people who have been scammed with fake court order and lawyers letters saying there representing a company just to gain access to the domain name they want.
It sound like a clear cut case to me, as long as the letter is guenuine. Either way noone would buy it given the Rolex connection I think.
I would ring up Rolex head office and get the low down on the whole thing though, just to be sure it is them...
The letter seems genuine and the law firm is legitimate (one of the largest in Australia I believe). I have also received an email from their company site. So looks like domain is lost. Thank you all for your input. Martin...
