Picture used, no credit
On the positive side, I guess this is like a right of passage ritual..

I found this article posted in the events section of my local paper - with my photograph. I had given one person permission to print some pictures of her daughter, but asked for credit if any pictures were published. The only reference I see in the article is to an unrelated video company, selling videos from the event I would assume..

The original picture is here, with what I thought was an obvious copyright;.

Oh well, like I said, I will take it as a sign that some of my pics are good enough for the local paper finally.

You need to contact the person you gave permission to, and the paper for publishing your photo. Obviously they did not take the photo from pbase, but got it from the person you gave permission to (assuming it had no copyright notice on it). Most likely the person you gave permission to is at fault as she probably told the paper it was her image..

If you blow up the image in the paper, you can see what is left of the pixelated copyright, it did come from pbase..

I am pretty sure it was the 'director' who submitted the article to the paper, and not the person I gave permission to. I had sent them both an email a week ago following up (before it was published) - and never received a reply or thank you or anything..

I'd be willing to bet the video company mentioned in the article is kicking back to the pageant based on sales (been there, done that) and so that's why they are emphasized..

In that case they should know better if they used the version with the copyright. Send them an invoice for use of your photo. If you have or know an attorney, have them write a letter. They are clearly in the wrong and should be made to atone for their carelessness. Be nice, reasonable and firm. No need to be a jerk, but as photographers we need to stand up for our rights, even it it may not seem like that big of a deal.

Submitted the following to the Timesnews photographers Blog. Maybe, a fellow photographer will help this paper see the error of their ways..

April 18th, 2008 at 9:07 pmTimesnews steals copyrighted Photos ? .

Your online article http://www.timesnews.net/community_article.php?id=2161 looks exactly like this copyrighted photo http://www.pbase.com/spiked3/image/94935773. Photographer is p[osting to online forums about having contacted the paper, to inform them of this violation of his copyright, yet a week later, he has recieved no reply, nor any fees for his image. Not even a credit. Is this how your paper normally conducts business? Are the papers copyrights free for any all use, by any and all who wish to use them? Curious..

Either way, I suggest you pursue this matter. Maybe with another local publication. Perhaps with the largest publication in your state. Papers love to trash each other, all the better when it's a competiter..

As mentioned, I post to their blog, about the illegal use of your image. Got a response from.

NDJII @ aol.com (Delete spaces).

BEGIN STATEMENT.

Hello From Hardtack and Hard Times;.

I can understand how the photographer feels being one myself. From time to time I will do a Google search for my own name and I am amazed to find where my photos end up being posted..

I can assure you the Times News respects all copyrights and does not steal photos. After doing a little checking the photo in question was submitted for publication on the Times News web site by Abingdon Pageant Courtier, LLC with no photo credit..

The photographer should contact them for distributing the photo for publication without notifying or crediting the photographer. I will pass on concerns to the powers that be over the web site so that they can take action in necessary..

END STATEMENT.

Looks like you need to contact Abingdon Pageant Courtier, about stealing images which do not belong to them.OR.

May want to offer the option to make the Event Photographer, providing you with exclusive Rights for all photography, at their next pagent.Obviously, they thought your pics were good enough to represent their Pageant.May as well make some money of the Event next time..

Either way, Good Luck!Dave PattersonMidwestshutterbug.com'When the light and composition are strong, nobodynotices things like resolution or pincushion distortion'Gary Friedman..

Thanks for forwarding that response. It was as I expected, that the 'director' copied the pic and sent it with the story. I assume the newspaper has some requirement that submitters of articles and pictures attest that they have rights to the images. Either the newspaper does not have a policy (shame on them) or the submitter ignored it..

After not receiving a reply to my previous followup to the 'director', I'm not suprised. It's a shame as these people are supposed to be role models for these girls. A 'thank you' would have went a long way..

Anyhow, no big deal to me. I vented on here, so I'm fine now. I certainly will think twice about posting the next pictures I take at that venue or others like it..

Even if all you are looking for is some credit and not monetary compensation..

Call the director, sent a certified mail with complaint, etc..

Doing nothing only encourages such behavior and in the long run hurts all photographers..
