Hey all. I have a domain that has the word photoshop in it. I'm just wondering if it's ok to put up a tutorial site, or photoshop related site...

I'm not sure but it's OK if it's gonna be a tutorials site...

I read somewhere that you are not alowwed to use "Photoshop" or "Adobe" in domain names now. I can remember the source but it was only a few days ago...

If a TMed domain is used in "fansite" or "sucks" fashion, thay are protected as long as the "rules" of "good faith" are followed. Just because a there is an established TM, it does not automatically give the holder holder exclusive rights to a domain name. If a TM holder goes after an infringing domain, they must prove 3 criteria. If they cannot prove all 3 criteria, the domain holder will prevail.

Be careful of what you read. Yes, Adobe and Photoshop along with Yahoo, Google and Ebay are very protective of theirs marks and they can overreach and try to bully domain owners. Then again, many domain owners DO register TMed domains hoping to profit from it. As long as the domain is used in "good faith" and cannot be proven otherwise, then the chances of retaining the domain is very good...

Well, just so I can be sure. The domain is photoshopcs.net.

It is very directly related to Adobe, as you can see, if this is an "everything photoshop cs" site, I should be ok as long as it is in good faith?..

Actually, I can't tell what it is by going to the site. I can't tell if it is good faith or bad faith. I must register in order to see what it is.... How do you think someone might view that? Me, I don't know, I could make arguements on both sides. But it could come down to, "is it good faith to collect personal information before you see the site?"...

Photoshopcs could very well mean the Photoshop Creative Suite and imo would be very risky to go after this. It might be a diffrent matter if it was Photoshopholics.net etc but cs is part of the brand...

It does not require registration..The site is not even up, that is for my control panel for the domain. You can't register it's a default page that is created when a domain is activated...

I had very similar questions too .. thanks guys for the responses (that clears a few of my questions too) .. I have the .org version of photoshopcs .. and also buyphotoshopcs.com .. Looks like you have a similar amazon shop as mine except that I have more categories .. I read on amazon.com that 'aStore' shouldn't be a stand alone site or something like that ..



Oh by the way, mine is still under construction .. jus the amazon shop is up ....

Adobe is super paranoid about this kind of thing. You can bet if they find out they'll come after you. A friend of mine registered a name with "Adobe" in it as a tutorials site, and he wrote their marketing dept to make sure it was OK. He immediately got a C&D and a demand to transfer the domain to Adobe...

If all you want to do is tutor folk about Photoshop, then don't say photoshoptutorials.com or whatever - just use a more generic term, like imagetutorials.com. Photoshop is the main online image thingie anyway, so surfers will still often check your generic image manipulating site. But if you insist on keeping "photoshop" in the name, remember the quickest way to lose all such domains overnight is by making money from - and linking to - a main COMPETITOR of Photoshop...
