I received a c&d from a law firm (representing gofreecredit .com) regarding a domain mini site "gofreecreditreport .com" in my portfolio... Requesting that I transfer domain to them... Should I transfer or seek legal counsel?..

I don't know about gofreecredit dot com, but freecreditreport dot com has a trademark, so either way, there is a trademark on free credit report. I doubt that I would turn it over to gofreecredit without proof of trademark http://tarr.uspto.gov/servlet/tarr?r...entry=78819076..

BTW, I checked the whois for gofreecredit .net and .org extensions which are owned by third parties... I would think that if their claim was valid against my domain with "report", it would certainly be valid against these.....

It probably doesn't really matter how many other people are infringing on a trademark in the long run. Free credit report dot com is running a national TV advertising campaign in the US so I'm sure they have the funds to go after all of them...

First be sure the C&D you got is real - many scammers send out fake ones in hopes of getting domains cheap or even free.

The credit bureaus / FICO and the numerous websites they own and/or operate, such as FreeCreditReport.com (owned by Experian I believe), are among the most shady and scummy outfits there are...

If they have you in their cross-hairs, you likely do best, unless the revenue you're earning from the domain is huge, to transfer ownership to them ...

DON'T sign anything though without professional legal assistance.

I often suggest folks in such situations to turn off auto-renew, unlock the domain, update the Whois to the entity's info, including admin email...

And then reply back indicating the domain ownership has been transferred, and include the Authcode for registrar transfer-out, if they wish to keep the domain beyond expiration. They may choose to let it lapse.

I checked everything out and it is in fact a legit claim. I sent an email to the attorney noting that even though the tm was filed in early '08, subsequent to the initial reg of late '06 that I would fully comply with this request. I also noted that I felt that perhaps it was more confusingly similar to freecreditreport .com... I mentioned that I could push into a fab acct or unlock for transfer, just waiting on additional info. Thanks again, this domain never really generated much traffic/ppc anyway.....

I wouldnt give it up that easy to them - At least ask for some for of compensation from them.

If they didnt reg a TM till 08 and you registered your domain in 06 you also dont have to hand it over to them.

Look into this in more detail.

Give it up? No way on Earth, especially on such a generic domain! If you don't want to deal with it, at least prolong the process for them, and let them pay $4500 + legal fees for a UDRP complaint. It doesn't cost you anything anyway...

Domain was regd Nov 13, 2006 and the tm's filed in March 10, 2008 and registered October 21, 2008. Obviously, I had no knowledge of gfc.com... Given the generic nature of this domain and the fact that I have not yet authorized the transfer, I may research the udrp process more closely...

In addition, the above site appears to be an affiliate site owned by a third party / individual. I think it's interesting that gfc.com would only pursue the .com version.....
