I would think embedding is okay because if the original video is taken down, your embedded code won't work any more.

Eventually you are going to have to learn that if it seems shady, then it probably is. There is legit money to be made out there.
And no, the DMCA would not provide you the same protection as YouTube has. There is a reason why that is, but I'll let you research it and figure it out...

Anyway, embeding and downloading are two different thing. I belive downloading and reupload somwhere else is a no no..
Even with embed there certain rules you need to follow. Have a read at the video site TOS. Just because it has embed features doesnt mean yo can do whatever you please with it, just like RSS Feed.
I do have site that embed youtube videos, and some of the videos do get taken down by youtube, and as the bove poster say, in that case, you just dont see the videos anymore, the place holder would just say that the videos been taken down..
