Current Status: An opposition is now pending at the Trademark Trial and Appeal Board.

The application will not survive, and this guy's own comments, in which he uses SEO as a common noun, are going to kill him.

If you want to do something constructive, Dave, look up the opposer in TTABVUE, and make sure their attorney has a copy of his own remarks on the blog...

It's ridiculous how this guy (jason gambert) tries to relate seo with accounting. seo is much more dynamic, subjective, and inherently less structured than accounting, otherwise serps would be manipulated like no other. I sincerely hope this trademark attempt falls through...

There have been some ridiculous tm's granted, but this blows them all out of the water imho...

Lets see... we have a descriptive term, used by thousands (millions?) across the globe... all you have to do is search SEO on any search engine. Even if they won, they would have to go after thousands, if not tens or hundreds of thousands of sites with seo in the name. The costs to defend their mark would be unsupportable.

Its quite an idiotic attempt imho.....

He's trying to copy what the National Board of Realtors have done, but in a careless manner. They created the name Realtor as a TM and separate name for a member Real Estate Agent so they can hold to a set of standards in the organization. That name itself has almost become generic by use. However, they at least at one time did make up the name and TM it, not try to TM a generic term already in use like this guy is trying to do.

I don't like the way some CEO's run their businesses. I think I'll get a TM on the term CEO and make them do it my way if they want to call themselves a CEO.....

Of course, trying to get the TM is one way in itself of making sure that he and his site get mentioned in all sorts of blogs, news sites, forums, etc. How much would it cost him in advertising to get listed in all the places that are talking about him for free now?.
