I checked USPTO and could not find any TM for 'ideal job' (in the States at least)... can you post the details you found about the TM? EG when was it filed, is it still live, which country was it trademarked in, etc...
The website I check on was businesslink.gov.uk/bdotg/action/cntc.....its a UK site. It says that it's still live..
Are .com names not affected by UK trademarks? If somebody got an international trade mark afterwards, would I be ok considering I bought the domain first?.
I just conducted a trademark search at: Intellectual Property Office - Welcome to the Intellectual Property Office (the UK trademark database).
There is, indeed, a live TM and it's not just for 'Ideal Job' but for:.
Trademark number: M746940.
I see from the whois that the domain registration predates the mark, but that won't help you if you purchased the domain after the TM was filed. I see that the TM was filed in 2000 and is due for renewal in September 2010.
The archive.org history shows results for 2000-2003 and then a three year gap after which it appears to have been parked. The original owner may have ceased operations and decided to sell or let the domain drop at some point. This might reduce the chances of them taking it from you, but the risk is still there IMO.
All based on my understanding only. I am not a lawyer.
How did you acquire the domain?..
It's all moot anyway; per OP's other thread on Namepros, idealjob.com is actually regged to someone else, and his registrar had a bug that allowed him to reg this as an available name when it wasn't; he said that has happened with 2 other names as well and he is waiting for a refund..
The funny thing is....they said it was a server error and had been sorted...yet the names are still there to buy! If you go to 'suggested domains'..
I think i'm going to report them.
Thanks for all your help guys...
