I have a domain name which I m not even sure if it is has a TM....

I went to the .com site and saw no trademark....

Now can I resell this domain?.

Or should I let it go... it is a .TV domain name..

Yikes.

Two thoughts: If it isn't an acronym and you aren't sure if there is a TM on the name without the .tv (Check google.com and uspto.gov for starters...), why the heck did you register it and now consider abandoning it? That just doesn't match up... Secondly, Really? http://www.dnjournal.com/ytd-sales-charts.htm might seem to indicate otherwise. The blanket statement that you can't sell a domain with a "TM issue" is too broad and generic to be accurate.

Sorry for my broad statement, in the case that a company would contact you regarding how your domain is very similar to their trademark, your domain would then have a trademark issue.

You cannot sell a domain with a possible trademark lawsuit pending since the previous owner of the domain can be sued for selling a domain with a their trademark...

That is your best bet with that domain, it is asking for a lawsuit.

The only end user you could sell it to, would be the people who could sue you for it. BTW did you look at http://www.starhotels.org/.

The fact that the site is up, and it says for sale, means that your fine selling your domain.

This company, Star Hotels, most likely doesn't care about people selling domains with their TM...

Or hasn't gotten around to caring yet, or any other myriad of reasons that does not include them note caring "about people selling domains with their TM.".

Quite likely, .tv doesn't fit them anyway and they are unlikely to think it is worth the time or effort to take it from you, but that doesn't mean that you have permission or a blank check to use the domain as you want.

Knowingly selling a potential TMed domain can never be deemed "fine" from anyone on this or any other forum unless that person has rights to the alleged TM and gave written to you to sell the domain. That is the only way you will be "fine" with selling it.

(there seemed to be selective reading in this thread, thought I would jump in)..
