The legality of "sucks" domains has been discussed in the past. I am sure there are many threads on it...
Palsucks.com is legal due to the freedom of free speech, you will note that the website paypalsucks.com has no ads, doesnt profit from there TM, so paypal cant say the owner is using his site to make money from there tm.
The problem with popularnameitunes.com is you are not using it as a freedom of speech site, your using it to make money...
Okay, it's quiz time....
1. Upon seeing the domain name "PaypalSucks.com", consumers might think the site is run by:.
(b) Someone who doesn't like Paypal.
2. Upon seeing the domain name TopTenITunes.com, consumers might think the site is run by:.

Ermm....do you give clues??? cause thats really hard to answer lol.
Confusingly similar is a term you should google...
I guess I will be in trouble by registering the "ItunesBooks.com" ? Btw, that is not my website, just bringing it as an example. The owner of that name is parked at godaddy.com..
And this is were most people slip up, this comes down to which side of the fence you prefer,.
Some people would say go ahead reg it, if they ask for it give it back,.
The others would say, dont do it, it's not worth the hassle etc...
Just because they havent been caught yet, doesnt make it right,.
The question is, in your opinion, is that domain really worth the hassle?..
As the domaining industry is affected by the slowing of the World Economy....
I've noticed that some domainers risk breaching Trade Marks, breaching the Terms of Service with Paypal and breaching the Terms of Service with Google adsense... Doing the Right Thing appears to be old fashion these days.
If you want to make money from the site.
It will limit your options.
1/ you will not be able to advertise itunes or any other apple products.
(check itunes affiliate TOS).
2/ You will not be able to run any context ads like adsense that has any itunes related ads without upseting apple.
Why incur the wrath of a large company like Apple.
When another usable name is a registration Fee away.
Try using your brains , check for potential problems with names BEFORE regging , not after...
Short answer: no. Long answer: read up on tm law and udrp rulings...
