I've just got my very first letter from an attorney representing HomeLearningCollege dot com (from United Kingdom).

I happened to own HomeLearningCollege dot net (here in United States) which I bought here at Namepros a couple of weeks ago hoping to develop it into a review course in the next couple of weeks. But when I woke up this morning I got a letter stating that I am using the domain in bad faith and must surrender the domain within 7 days or else....

Any thoughts on this?.

Is this a losing cause?.

Unless they have trade-marked this name, I don't see how they can force you to give up the name, it's a generic name in my opinion.

Since the company is based in the UK, I don't even know if you can search for the TM patent here in the US!.

I would consult a lawyer to see your options...

Legal advice would be good, but seeing as the .com & .co.uk only cover the UK. I don't see how doing something based around the US is bad faith. Also people rarely go to .net by mistake instead of .com.

Get some advice, make sure the page isn't park. Even a placeholder or something is better stating your intentions for the domain.

It would also be feasible to redirect anyone from UK to the .com site instead of yours or at least give people from UK that option or have a popup stating this is for US residence. I have received letters/emails regarding a few of my domains, but so far disputes have never gone beyond this, mainly because I have been able to prove it wasn't bad faith and I have a genuine interest in the name.

Not a losing case by any means, but hard to say how it will go...

More info needed. You say that they have accused you of using the domain in bad faith,.

So it would help if you told us what you have done with the domain..

If you have had it parked and it was showing ads, there is a strong possibility that you have contravened their rights...

I have just recently obtained this domain from an auction here at Namepros and It was already parked before I even acquired it. The reason that I bought this domain is to develop it into a blog or website in the near future. However I current have other projects at this moment and I could not have possibly just drop what I was working on and work on this newly acquired domain.

Thanks for those who have made suggestions and comments. But please keep them coming.

Also how much would it cost to consult a lawyer here in the US regarding a domain and trademark?..

You don't need to work on that project. Just put an under construction page. Don't park the domain. You will get $0.01 from parking if that. Why do you still park?..

I already changed the DNS server last night and placed a 1 page description on the site describing what the site will be. The current registrar stated that the DNS redirection may take as long as 24 hours to become effective...

Just ignore them, they are tyring to scare you. and this is not US...

Sure HLC's essentially scaring the OP, but it's because they have an enforceable claim. While they're U.K.-based, they can always use the Uniform Dispute Resolution Policy (look it up online) to pursue those outside their jurisdiction.

Oh, and welcome aboard. Keep looking around so you'll see and learn there's more to this than what you probably think...

Thanks for the feedback guys. I have removed the domain away from parking and added 1 page of written material. But I think it's not enough.

Any other suggestions is greatly appreciated...
